What We’re Reading: New Report from Nation’s Criminal Defense Bar Highlights Widespread Coercive Plea Bargaining in Connecticut

Released March 26, 2026 by NACDL

The National Association of Criminal Defense Lawyers has released a new report co-authored with Connecticut defense lawyers and the state’s Chief Public Defender titled “The Trial Penalty in Connecticut: Are People Being Punished for Exercising Their Constitutional Rights?” The report finds that defendants across Connecticut are losing their Sixth Amendment right to trial because the difference in sentencing between accepting a plea deal and going to trial is so extreme that many feel forced to plead guilty even when they may be innocent.

This is relevant to Tennessee defendants for two reasons:

  1. Coercive plea practices are not unique to Connecticut. Criminal defense attorneys nationwide, including here in Wilson County, TN, see similar pressure tactics where the threat of decades‑long sentencing if someone goes to trial can make a plea deal feel like the only realistic option, even when there are defenses or evidentiary issues.
  2. The report underscores why experienced counsel matters. A skilled criminal defense attorney can help clients understand their actual risks, not the worst‑case headlines. An attorney who knows how to investigate, challenge evidence, and negotiate from strength can often achieve better outcomes without forcing a client into a plea that carries long‑term consequences.
